Georgia Notaries Public: The office of the Clerk of Superior Court approves and issues commissions of Notary Public. Each commission is for a term of four years and may be renewed prior to the Expiration of the notary's term of office. The Clerk of Superior Court is located on the first floor, east wing of the Gwinnett Justice and Administration Center.

Powers & Duties

  • Notary Public have authority within any county in the State of Georgia to:
    • Witness or attest signature or execution of deeds and other written instruments.
    • Take acknowledgments
    • Administer oaths and affirmations in all matters incidental to their duties as commercial officers and all other oaths and affirmations which are not by law required to be administered by a particular officer.
    • Witness affidavits upon oath or affirmation.
    • Take verifications upon oath or affirmation.
    • Make certified copies, provided that the document presented for copying is an original document and is neither a public record nor a publicly recorded document certified copies of which are available from an official source other than a notary and provided further that the document was photocopied under supervision of the notary.
    • Perform such other acts as notaries are authorized to perform by the laws of the State of Georgia.

  • Definitions:
    • A "notarial act" means any act that a notary is authorized to perform and includes, attestations, the taking of an acknowledgement, the administration of an oath or affirmation, the taking of a verification upon oath or affirmation, and certification of a copy.
    • "Attesting" and "Attestation" mean the notarial act of witnessing or attesting a signature or execution of a deed or other written instrument, where such notarial act does not involve the taking of an acknowledgement, the administering of an oath or affirmation, the taking of a verification, or the certification of a copy.
    • "Notarial certificate" means the notary's documentation of a notarial act.

 

Instructions for New Application

Any individual interested in becoming a Notary Public shall submit application to the Clerk of Superior Court of the county in which the individual resides or, when applying under the provisions of Code Section 45-17-7, to the Clerk of Superior Court of the county in which the individual works or has a business. The applicant shall sign and swear or affirm as to the truthfulness of the application.

  • Applications must be completed and printed online at Clerks' Authority website: http://www.gsccca.org/Projects/npapp.asp.

  • All new notary applicants must complete the online notary training available at https://eLearn.gsccca.org. There is a $2 fee associated with completion of the class and final exam. You need a 90% or higher to receive the completion certificate. This certificate will need to be presented with your completed application. Exemption for attorneys only - a current Georgia Bar card will need to be presented in lieu of testing.

  • You must appear in person to the Clerk of Superior Court office located on the 1st floor, east wing of Gwinnett Justice and Administration Center between Monday - Friday 8:00am - 5:00pm.

  • The fee is $52.00 payable to Clerk of Superior Court, Gwinnett County (cash, check or money order ONLY).

  • Verification of residence is required
    • A valid Georgia driver's license (Temporary licenses are NOT acceptable);
    • A valid United States passport;
    • A valid voter identification card; or
    • Such other valid identification by a local or state government or by the United States government.
    • For holders of LPR (Legal Permanent Resident) or DACA
      • Addendum A must be printed and filled out
      • Card must be presented
    • For holders of Work Visas *must reflect as valid 2 years or longer* (those less than 2 years will be reviewed on a case by case basis)
      • Addendum B must be printed and filled out
      • A letter from employer stating (a) how long employed and (b) whether being commissioned Notary is required for their job on official letterhead
      • Card must be presented

  • The applicant must provide a home address on all applications as their official contact address. Business addresses or P. O. Boxes are not acceptable. If the address on your driver’s license is different than the address on your application you must also provide one of the following that has the application address and your name listed: Valid vehicle registration, valid voter’s registration, valid weapons carry permit, or a valid property tax bill.

Instructions for Renewal Applications

Renewal Applications are valid only for those holding a current unexpired appointment from Gwinnett County.

  • Submit original signed and notarized renewal application – with:
    • Valid driver’s license/ID (Address must match application)
    • Payment of $52.00 cash, check or money order made payable to Clerk of Superior Court, Gwinnett County.
    • *NO DEBIT/CREDIT CARDS – NOT ACCEPTED*

  • Verification/Proof of your identity and residence is required. (Photo ID & physical address – No P.O. Boxes/Work addresses)
    • Valid Georgia driver's license/ID card (No temporary licenses) with Current Name and Physical Residence *Preferred Proof*;
    • Valid Weapons Permit;
    • Valid United States Passport (Identity Only);
    • Valid Vehicle Registration (Residence Only);
    • Current Voter’s Registration (Residence Only);
    • Current County Tax Bill/Receipt (Residence Only)
    • If bordering state renewal: present valid resident state driver’s license

  • Holders of LPR (Legal Permanent Resident) or DACA

Renewal Application Instructions

 

Change of Name or Residence

Every notary shall notify this office, in writing, with a copy to the Georgia Clerk's Cooperative Authority of any change in the notary's address or name. The notice shall contain both the old and new address or name and must be received by this office within 30 days of the change. In the event of a name change the new signature of the notary must be included.

A notary with a new name may begin to officially sign the new name when the notice has been received by this office; a confirmation of the name change has been received from this office and a new seal bearing the new name has been obtained.

Notice of Name / Address / Contact Info Change

 

Seal of Office & Notarial Certificates

Each notary must provide a seal of office for the authentication of notarial acts. Gwinnett notary's such seal shall have the notary's name and the words "Notary Public Gwinnett County Georgia". Embossment of notarial certificate by the such seal is authorized but not necessary, and the use of a rubber or other type stamp shall be sufficient for imprinting the notary's seal.

 

Notice of loss or theft of seal

Within ten days of the loss or theft of an official seal the notary shall send a written notice of such loss or theft. Send Loss or Theft notices to:

The filing fee for Notary is $52.00 and can be paid by cash, check or money order.
